Apex Sports Academy Agreement and Release of Liability

1.   Membership:By signing this membership application, I agree to the following:

·       I am fully responsible for all charges made to my account. These include membership fees, meet fees and all other charges deemed necessary.

·       I agree with all billing policies as they are laid out.

·       I agree with the behaviour guidelines of Apex Sports Academy.

·       I understand that my Apex Sports Academy reserve the right to terminate my membership where there are unpaid arrears for sixty (60) or more days, and that this will be handed to a third party for collection.

·       Termination of my membership by either myself or Apex Sports Academy during the swimming season will be charged at 50AED.

·       I agree to notify the Membership Officer of my decision to cancel membership as soon as possible.

·       I will be responsible for all ongoing fees until I serve notice of cancellation.

·       Apex Sports Academy and all of its employees are not liable for any claims, demands, injuries, damages, theft/or loss at any of its sites, travel to/from training or competitions and any extra activities that are provided by the Academy for myself or my child.

·       I voluntarily assume all risks associated with myself, my child and any other person attending on my behalf. The company and its employees will not be held liable.

2.   Personal Information Protection:

·       Information provided in this registration form will be used for the purposes deemed reasonable by the company and its partners.

·       These include national, regional and event registration. Insurance coverage, training participation, competition result publication.

·       The information will also be used for registration with the swimming association.

·       This information will allow us to make sure we do all of the following as an Academy:

a)         Ensuring swimmers train and compete in an age appropriate environment;

b)         Establishing athlete eligibility for selection to swim teams;

c)         Establishing pertinent medical records and baseline performance data to assist coaching decisions in a national team competitive or training setting;

d)         Reporting and publishing athletes’ name, gender, age, club affiliation on Swimming/ tennis/ sports web pages or in results, news releases and ranking reports and;

e)          Making direct contact with registrants, volunteers and staff as necessary for the operations of the Club

 

3.   Photographic and Email Release

·       I understand that photographs and/or videos may be taken from time to time at Apex Sports Academy activities.

·       I agree that Apex Sports Academy and City of Dubai may use such photographs and videos to promote swimming, tennis and the Academy.

·       I give express consent to Apex Sports Academy to use the email address/es provided on this form for all communication.

 

4.   Cancellation/Refund/Make-up classes Policies

·       Registration cancellation 72 hours or more before the commencement of classes will be honoured with a refund within ten (10) days of request.

·       Registration cancellation from 48 hours prior to seven (7) days after commencement of classes.

·       Apex reserve the right to combine and/or cancel classes in the event of insufficient enrolment.

·       Please check your schedule before committing to classes as refunds/make up classes will not be offered to people missing for personal conflicts.

·       Medical exemptions will be considered (with medical certificate) and should be communicated to admin and site lead as soon as possible so that make up classes can be offered.

·       All refund requests are considered on a case by case basis and will be either offered Apex Credit or full refund dependant upon the circumstances.

·       Apex Credit will last one (1) year from issue and are redeemable against any Apex chargeable program.

·       These policies apply to all Apex Sports Academy fee based programmes.

·       Admin is the first point of contact for all refund/make up lesson enquires.
